THIS IS A LEGAL AGREEMENT BETWEEN YOU AND JOHNKIRKPHOTO.COM.AU. BY INSTALLING THE CD AND VIEWING ITS CONTENT YOU AGREE TO ACCEPT AND BE COVERED BY THESE CONDITIONS.

DEFINITIONS

"The Content" means any photographic image, illustration, digital animation, film, video or other visual representation plus any words or sounds recorded in any format. "You" includes the customer/your employer, its employees, agents and any other party acting on your behalf.

GRANT OF LICENCE

Once You have paid the fee agreed with JOHNKIRKPHOTO.COM.AU, JOHNKIRKPHOTO.COM.AU grants You a non-exclusive licence to use and modify The Content subject to the restrictions in this Agreement. An Exclusive licence is also available.

PERMITTED USE

For a High Resolution licence, You may use The Content in:

Your personal, professional, internal, editorial and client projects including as part of electronic or printed material (including on-line display) but excluding use as a cover of printed material or as a poster (ie, a 1 page printed document).

For a Low Resolution licence, You may use The Content in:

Your personal, professional, internal, editorial and client projects but only as part of electronic material which consists of on-line display or powerpoint/other electronic display presentations and only in a low resolution format (ie, 72 dpi or less). The content may be distributed within the same company via a network or asset management system.

NOT PERMITTED USE

You may not use The Content in a Website at a resolution higher than 72dpi, post The Content on any bulletin board, or place The Content on-line in a downloadable format. You may not use any of The Content to create defamatory or obscene material. You may not resell, transfer or grant any rights to The Content or any compilation or derivative work containing The Content to any other person or entity without the prior written consent of JOHNKIRKPHOTO.COM.AU.

TERMINATION

If you use The Content in a way not permitted by this Agreement without prior written consent from JOHNKIRKPHOTO.COM.AU You will infringe Australian copyright law. If You do not comply with the conditions of this Agreement, this licence automatically terminates. On termination, all copies of The Content must be returned to JOHNKIRKPHOTO.COM.AU immediately.

COPYRIGHT

The Copyright in all of The Content is owned by JOHNKIRKPHOTO.COM.AU or its licensors and is protected by Australian and international Copyright laws and other applicable laws. No title or intellectual property rights in The Content are transferred to You. All rights not expressly granted by this licence are retained by JOHNKIRKPHOTO.COM.AU.

LIMITED WARRANTY

JOHNKIRKPHOTO.COM.AU warrants The Content to be free from defects in material for 90 days from delivery. Your only remedy for a breach of this warranty is the replacement of The Content.
